AC Issue

Moved in a few months ago with no AC, I decided that with Summer on its way I should organise AC with EMICOOL.
EMICOOL need Landlord to sign aggrement form before they will start AC, my problem is that I cannot get my Landlord to answer EMICOOL's request to sign and return form. I know the Landlord is still alive as he has cashed the second check!
I have also been in contact with my letting agent asking him to contact Landlord but still nothing is moving.
Can anyone offer any suggestions as to my leagal status on this matter?

Emicool operates its services in line with an agreement (40 year agreement) with the landlord.

Emicool has no relationship with the tenant.

If there is any default in settlement of Emicool dues (or DEWA dues) the landlord will be held accountable.

I cannot see any way out for you. You are the mercy of Emicool or should I say your landlord.

I understand the Landlord may be king and I repect that.
I have also highlighted another problem with my so called agent, I have also requested that he pulls his finger out and contacts the Landlord but nothing so far.
What would happen if I cancelled my remaining checks?

A cheque once issued must be honoured and cannot be cancelled. A dishonoured cheque will land the issuer in jail. This is the law in the UAE.

You can approach RERA at the Dubai Land Department office (http://www.dubailand.gov.ae) and file a complaint against the landlord.

RERA may ask whether the lease agreement has been endorsed by their office. They had put out an ad over a year ago making it mandatory for all lease agreements to be endorsed/stamped by the Dubai Land Department. In the absence of this endorsement the ad stated the Dubai government would not involve itself in enforcing the lease.

If RERA does not get involved a law suit would be the last resort.

Landlord tenant disputes have normally been heard by the Rent Disputes Commitee of Dubai Municipality. They will ask the appelant to deposit a fee (around 5% of the rent) to call both parties for a hearing. The loosing party has to pony up the hearing fees.
